1. Acceptance of Terms
By accessing or using the Fainda platform, including the Fainda website and mobile application, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.
These terms constitute a legally binding agreement between you and Zigma Wave Limited, the operator of Fainda. We may update these terms from time to time, and your continued use of the platform after changes are posted constitutes acceptance of the revised terms.
2. User Accounts
To access certain features of Fainda, you may need to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials and not share them with others.
- Promptly update your account information if it changes.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorised use of your account.
You must be at least 18 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these terms.
3. Acceptable Use
When using Fainda, you agree not to:
- Post false, misleading, or inaccurate information about any business or service.
- Use the platform to harass, abuse, or harm another person or entity.
- Attempt to gain unauthorised access to any part of the platform or its systems.
- Use automated tools (bots, scrapers) to access or collect data from the platform without our written permission.
- Reproduce, duplicate, or exploit any part of the platform for commercial purposes without authorization.
- Upload content that infringes on the intellectual property rights of others.
- Use the platform for any activity that violates Nigerian law or applicable regulations.
4. Intellectual Property
All content, design, logos, trademarks, and software associated with Fainda are the property of Zigma Wave Limited or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the platform without prior written consent.
By submitting reviews, ratings, or other content to Fainda, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content in connection with the operation of the platform.
5. Limitation of Liability
Fainda is provided on an "as is" and "as available" basis. While we strive to ensure the accuracy of all listings and information, we do not guarantee that the platform will be error-free, uninterrupted, or free of harmful components.
To the maximum extent permitted by Nigerian law, Zigma Wave Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the platform. Our total liability shall not exceed the amount you have paid us, if any, in the twelve months preceding the claim.
6. Termination
We reserve the right to suspend or terminate your access to Fainda at our sole discretion, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reasonable reason.
Upon termination, your right to use the platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes.
7. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in Enugu, Nigeria.
